TERMS & CONDITIONS / ASSUMPTION OF RISK & RELEASE OF LIABILITY

BY PURCHASING AND/OR PRESENTING A TICKET, HOLDER ACKNOWLEDGES THAT THEY HAVE READ, UNDERSTOOD, AND VOLUNTARILY AGREED TO THESE TERMS AND CONDITIONS, INCLUDING THE ASSUMPTION OF RISK AND RELEASE OF LIABILITY.

This document constitutes a binding legal agreement between the ticket holder (“Holder”) and Thirteenth Hour Productions, LLC, an Indiana limited liability company, including its owners, officers, employees, agents, contractors, volunteers, affiliates, landlords, successors, and assigns (collectively, the “Released Parties”).

1. ALL SALES FINAL – NO REFUNDS

All ticket sales are final. No refunds, exchanges, or cancellations will be issued for any reason, including but not limited to illness, weather, missed entry times, or dissatisfaction. If the event is cancelled by the Released Parties due to inclement weather, public safety concerns, or other causes beyond their control, Holder’s ticket may be honored on another operating date of equal value, subject to availability. If the replacement date has a higher ticket price, Holder is responsible for paying the difference.

2. TICKET USE & ADMISSION

Each ticket is a revocable license and grants one-time admission for the date and time selected.

Tickets contain unique barcodes. Only the first valid scan will be admitted; duplicates will be denied entry.

Holder may be required to present a valid government-issued photo ID and the payment method used for purchase.

Tickets are not valid with any other discounts, promotions, or special offers unless expressly stated.

The Released Parties reserve the right to refuse admission or remove any person without refund for violation of posted rules or staff instructions, unsafe behavior, or conduct deemed detrimental to the event.

3. PROHIBITED ITEMS & CONDUCT

The following are strictly prohibited on event property:

Bags, backpacks, purses, or similar items of any size

Weapons of any kind (including pocketknives, pepper spray, and replica weapons)

Fireworks, explosives, lighters, matches, vaping devices, or e-cigarettes inside the attraction

Outside food, beverages, or alcohol

Holder shall not: smoke, vape, run, eat, drink, touch actors or other patrons, or handle props/sets. Photography and videography inside the attraction are prohibited without prior written consent.

4. HEALTH & PARTICIPATION REQUIREMENTS

The Thirteenth Hour features intense audio, strobe lighting, fog, sudden scares, confined spaces, uneven terrain, damp or slippery conditions, and other special effects.

Holder SHOULD NOT ENTER if they:

Are pregnant or may be pregnant

Have heart conditions, asthma, epilepsy, or other respiratory/seizure disorders

Have physical limitations, broken bones, casts, or require mobility aids

Suffer from high anxiety, PTSD, or severe claustrophobia

Are under the influence of alcohol, illegal substances, or impairing medications

The Released Parties reserve the right to deny entry if such conditions are observed or suspected.

5. ACKNOWLEDGEMENT OF RISKS

Holder acknowledges that participation in haunted attraction activities involves known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to property. These risks may be caused by the negligence of the Released Parties, other participants, environmental conditions, or other causes.

6. ASSUMPTION OF RISK & RELEASE

Holder, on behalf of themselves, their heirs, executors, administrators, and assigns, voluntarily assumes all risks associated with attending the event and releases, waives, and discharges the Released Parties from any and all liability, claims, demands, actions, or causes of action whatsoever arising from or related to any loss, damage, injury, illness, or death, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE.

7. INDEMNIFICATION

Holder agrees to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost, including court costs and attorneys’ fees, that they may incur due to Holder’s participation, WHETHER CAUSED BY NEGLIGENCE OR OTHERWISE.

8. INCIDENTAL CONTACT & MATERIALS

Performers are instructed not to intentionally touch patrons; however, incidental physical contact may occur. Holder may come into contact with fake blood, fog, pigments, or other substances which may stain clothing or cause minor irritation. The Released Parties are not responsible for damage to personal property.

9. PHOTO/VIDEO RELEASE

Holder grants the Released Parties the right to capture and use Holder’s image, likeness, voice, and/or performance in photographs, audio, or video for any lawful purpose, including advertising and promotional materials, in any media, without compensation or further notice.

10. COVID-19 / COMMUNICABLE DISEASE NOTICE

Holder acknowledges that COVID-19 and other communicable diseases are contagious and voluntarily assumes all risks of exposure or infection, which may result in illness, disability, or death. Holder agrees not to attend if experiencing symptoms, having tested positive within the past 10 days, or having been advised to quarantine. Holder releases the Released Parties from any claims related to such exposure or infection.

11. GOVERNING LAW & SEVERABILITY

This Agreement shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to conflict of laws principles. If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.
